ARTICLE 1 – PURPOSE

These General Terms and Conditions of Sale (T&Cs) govern the sale of products by GLOBE TROTOYS, 25 rue Léon Gaumont – ZA de la Pentecôte, 44700 Orvault, France (RCS Nantes no. 493543896, EU VAT number: FR32493543896), via the website www.deglingos.com.

The products concerned include, but are not limited to: soft toys, comforters, backpacks, early learning toys, and travel bags.

ARTICLE 2 – PRICES

Prices are indicated in euros, including all taxes (VAT included), excluding delivery costs. The total amount due is shown before order confirmation.

For deliveries outside mainland France, customs duties or taxes may apply. These are the sole responsibility of the customer, who is considered the importer.

Prices may be changed at any time, but products are invoiced based on the rates in effect at the time of the order.

Products remain the property of GLOBE TROTOYS until full payment is received.

Once the customer physically receives the products, the risks (loss, damage) are transferred.

ARTICLE 3 – ORDERS

Orders are placed exclusively on www.deglingos.com. Contractual information is provided in French.

GLOBE TROTOYS reserves the right to refuse any order or payment for legitimate reasons (e.g., suspected fraud, supply issues).

ARTICLE 4 – ORDER CONFIRMATION

Any confirmed order implies full acceptance of these T&Cs.

An order confirmation is sent by email.

ARTICLE 5 – PAYMENT

Payment is made by credit card (CB, Visa, Mastercard), ShopPay, or PayPal. The amount is debited at the time the order is confirmed.

Payments are secured via approved providers. No banking data is stored by GLOBE TROTOYS.

ARTICLE 6 – RIGHT OF WITHDRAWAL

In accordance with Article L221-18 of the French Consumer Code, the customer has 14 days to exercise their right of withdrawal from the date of product receipt.

The request can be made via our contact form or by any means clearly expressing the wish to withdraw.

Returns must be made within 14 days, in their original condition (packaging, labels still attached, new and unused). The customer is responsible for the condition of returned items. Any damage may void the right of withdrawal. Return shipping costs are the customer's responsibility.

Refunds are issued within 14 days of receipt of the withdrawal request, using the same payment method as the original order.  Shipping costs will not be refunded nor duty fees (if order placed outside of France).

Exceptions: see Article L221-28 of the Consumer Code (personalized or unsealed products, etc.)

ARTICLE 7 – AVAILABILITY

Products are offered while stocks last. If a product is unavailable after ordering, you will be notified by email. A refund will be issued automatically.

GLOBE TROTOYS reserves the right to refuse orders of more than 10 identical items.

ARTICLE 8 – DELIVERY

Products are delivered to the address provided when the order is placed.

Delivery times are specified during order confirmation. In case of delay, you will be notified by email with the updated delivery estimate.

If a parcel is returned due to an incorrect address or failure to collect it in time, the customer will be notified. If no response is received within 48 hours, the order may be cancelled. Shipping costs will not be refunded unless the error is attributable to GLOBE TROTOYS.

If delivery is delayed by more than 30 days, the customer may cancel the order in accordance with Article L216-2 of the French Consumer Code.

ARTICLE 9 – LEGAL WARRANTIES

All products are covered by:

• the legal warranty of conformity (Articles L217-3 to L217-20 of the French Consumer Code),

• the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).

In case of defect, the customer may request repair, replacement, or a refund.

The warranty applies for 2 years from the date of delivery. No proof of the defect is required during this period. The warranty does not cover damage caused by improper use, poor maintenance (washing not in line with care label), accidents or falls (e.g., pet damage, iron burns), or wear and tear (faded or torn fabric, holes). Second-hand products are not covered under the legal warranty.

ARTICLE 10 – LIABILITY

GLOBE TROTOYS cannot be held responsible for misuse of the products or non-compliance with local laws when delivering outside France.

We are not responsible for internet-related issues (e.g., outages, viruses).

ARTICLE 11 – APPLICABLE LAW AND DISPUTES

These T&Cs are subject to French law. In case of dispute, only French courts shall have jurisdiction.

ARTICLE 12 – INTELLECTUAL PROPERTY

All elements of the website www.deglingos.com are protected by intellectual property law. Any reproduction, even partial, is prohibited without prior written consent.

ARTICLE 13 – PERSONAL DATA (GDPR)

Data collected is processed in compliance with the General Data Protection Regulation (GDPR).

You have the following rights: access, rectification, opposition, erasure, restriction, and portability. These can be exercised via our contact form.

Data is used for order processing, sending information, and improving services. Some data may be shared with service providers (payment, delivery).

In accordance with the French law of January 6, 1978, you have the right to access, modify, and oppose the processing of your personal data directly via the website.

ARTICLE 14 – ARCHIVING – PROOF

Order forms and invoices are archived on reliable media. They constitute proof of the transaction, in accordance with Article 1366 of the French Civil Code.
